Policy

1007MACFM stores no files. The index holds descriptions, file names, checksums and links pointing at storage operated by other parties. When a valid notice is received, the entry it concerns is removed from the index and the link is dropped. That happens on receipt, not after a discussion.

What a notice needs

Send it through the form below rather than any other route. A notice needs to identify the work, identify the entry, and come from someone entitled to send it. Specifically it needs to contain the following.

  • Identification of the copyrighted work you say is being infringed
  • The exact address of the entry on this index, one address per work
  • Your name, the rights holder you act for, and a working reply address
  • A statement that you believe in good faith that the use is not authorised by the rights holder or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act
  • Your electronic signature, which for this purpose means your full legal name typed into the form

What happens after you send it

The notice lands in the same queue as everything else and is handled ahead of it. The entry comes down first and is read second. You get a reply confirming what was removed and when.

A notice that names a whole category, or that names no specific address at all, cannot be actioned as written. It will get a reply asking for addresses rather than being ignored, but that adds days for no reason. One notice per work, with the address on it, is always faster.

Counter notices

If your entry was removed and you believe that was a mistake, write in through the same form and say so. Include the address that was removed, why you believe the removal was wrong, and a reply address. The desk does not restore entries automatically and does not act as an arbitrator between parties, but a counter notice is read by a person.

Repeat notices

Where a rights holder sends notices covering the same publisher repeatedly, the desk will stop indexing that publisher's titles altogether rather than working through them one at a time. If you are in that position, say so in the notice and it will be handled that way.
